Why do I have to go to Mediation?

You've been given a court order to Mediate, why?

First of all, I understand that you may be frustrated. After all, you just want the court to hear your side of the story and make a decision for you.  Then you receive a notice from the court that says something to the effect of "you've been ordered to have a mediation before the court will hear your case", or something like that.

No, it's not you!  The court system is very much under a huge workload, with lots and lots of cases to hear.  Like any other organization, it wants to be as cost-efficient as possible, while also meeting the needs of the public.  One way to help alleviate the workload and keep costs low is to see if some of those cases could actually be solved, even partially outside of the court, say in MEDIATION!  Hey, that's where I come in.  If both parties are truly interested in seeing if they can come to some mutually beneficial agreement, you can come to mediation, work with the mediator, find an agreement or partial agreement and not have to go on to court.  You are not being told that you have to find an agreement in mediation, just that you will give it "a good faith effort".

So, be sure and show up for your mediation, come with an open mind to the possibility of finding an agreeable position and let your mediator help you.
